The question of which court will hear a claim against a clinician abroad, which country's law it will apply, how long the claimant has to bring it, and whether any judgment can be collected. The CDC puts the position in one sentence: patients "might not have the same legal recourse as they would if they received their care in the United States". The American Medical Association's guiding principles ask that patients be informed of their rights and legal recourse before agreeing to travel.

The story Inference

The subject has a founding legal text. Nathan Cortez's Patients Without Borders, at 83 Indiana Law Journal 71 (2008), set out the problem as one of health law rather than tort: a body of consumer protection, licensing, insurance regulation and malpractice liability that was built nationally and does not follow a patient across a frontier. I. Glenn Cohen's Patients with Passports (Oxford University Press, 2014) is the book-length treatment.

What little empirical work exists looks at the destination rather than the source. Crooks, Cohen and colleagues convened nine lawyers in Barbados in February 2014 and found liability the first of five themes they raised unprompted; the ability of arriving patients to recover damages for an adverse event was one of the two concerns the authors identified as predominant both in the room and in the literature.

Inference — the structural position is four separate obstacles, each of which is enough on its own. A suit brought at home must first establish that the home court has jurisdiction over a defendant who never traded there, and may be met with an argument that the proper forum is the country where the treatment happened. A suit brought there is governed by that country's law, including its limitation period and any statutory cap on damages, and is litigated in its language through local counsel. Damages awarded in either place reflect the cost of care where the award is made, not where the claimant will be treated. And a judgment is a piece of paper until a court where the defendant holds assets agrees to enforce it, which is a matter of bilateral arrangements that mostly do not exist between source markets and destinations.

None of that is specific to a bad clinic. It applies equally to a university hospital.

How it works Trade practice

Contracts in this trade commonly name a governing law and a forum, and where a facilitator is involved its terms usually distinguish its own obligations — introducing, booking, arranging — from the clinical obligations of the treating facility. This project has read no such contract and holds none; the terms are private documents between a patient and a company.
