US registers say gestational carrier. UK law says the surrogate, and calls her the mother until a court says otherwise. Agencies say journey, and price it as one.

A woman carries a pregnancy for someone else. In the usual form an embryo is created by IVF from the intended parents' or donors' gametes and transferred to her; she has no genetic link to the child. The medical part is a frozen embryo transfer, which is an outpatient appointment. Everything expensive and everything contested is elsewhere: the screening, the insurance, the compensation, the contract, and the legal step that moves parenthood from the woman who gave birth to the people who commissioned the pregnancy.

Root. surrogate: Latin surrogare, to put in another's place — sub, in place of, plus rogare, to ask or propose, a word from Roman public law about substituting one officeholder for another. The pregnancy, not the parenthood, is what is substituted, and the two come apart in court.
gestational surrogacy uses an embryo made from other people's gametes, so the surrogate is not genetically related to the child; traditional surrogacy uses her own egg. Statutes treat the two differently, and a price page usually means the first. Trade practice

Surrogacy is the case where the law does not merely change the price. It changes whether the thing exists.

The UK regulator states the English position in flat terms: a surrogate in the UK cannot be paid except for reasonable expenses; the agreement is not legally binding; the surrogate is the legal mother of the child unless a parental order is obtained, whatever the gametes were and whoever the intended parents are; and a foreign birth certificate naming the intended parents does not change any of that, because UK law recognises the surrogate as the legal parent until the order is made. Anything paid above reasonable expenses has to be authorised by the family court before an order can be granted.

The United States prices what England forbids. Circle Surrogacy publishes a fixed-cost programme at 189,500 US dollars covering agency fees, surrogate base compensation, screening, insurance and legal fees, with surrogate compensation stated at 60,000 to 75,000 dollars and above — and IVF and egg-donor costs explicitly outside the total, egg donors themselves running 30,000 to 60,000 dollars.

Inference — the two paragraphs above are the same transaction viewed from two jurisdictions, and the gap between them is what generates the travel. Cohen's term for travelling to do lawfully abroad what is criminal at home is circumvention tourism; where the traveller feels pushed rather than pulled, Inhorn and Patrizio's word is exile. Priced as a programme, not a procedure, and the programme is mostly other people's fees. The published US total separates into agency fee, surrogate compensation, medical insurance for the surrogate and the baby, screening, and legal fees for both sides — and then sets the IVF itself and any egg donor outside the total, which is the single largest exclusion on any price in this batch. Payment is staged against events rather than months: 56,500 dollars at sign-on and 133,000 dollars at match, on the published schedule.

The legal facts that decide the destination are three. Whether surrogacy is lawful at all for a non-resident. Whether payment beyond expenses is lawful, which separates a compensated market from an altruistic one and roughly decides the supply of surrogates. And how parenthood transfers: a pre-birth order in the destination, an adoption, or a home-country parental order obtained after the family returns, which is the UK route and which no foreign document replaces. A fourth question decides whether the child can leave at all — nationality and travel documents — and it is where cross-border arrangements fail in practice rather than in principle.

The clinical bill is small beside all of this and is bought separately. Reprofit in Brno prices the consultation and preparation of a frozen transfer for a patient using a surrogate and the patient's own imported embryos at 680 EUR, with the transfer itself another 815 EUR: twice the fee for the same preparation without a surrogate, and still a rounding error against the programme price.
